Aan de leden van Vaste Commissie voor Justitie van de Tweede Kamer

Op 30 januari 2004 heeft het VN-Comité inzake de Rechten van het Kind het volgende advies uitgebracht:

The Committee (on the Right of the Child, in its Concluding Observations, of 30 January 2004, par. 54) recommends that the State party in the Netherlands:

a) Review the Aliens Act of 2001 and its application to ensure full conformity with international standards applicable to refugees and to the Convention;
b) change its definition of unaccompanied minor seeking asylum so as to conform to international standards;
c) ensure that determination of refugee status of minors adheres to international standards, and consequently reconsider the 48-hour accelerated procedure;
d) ensure that detention of children whose refugee application has been rejected is used only as a last resort, and that all children awaiting expulsion receive adequate education and housing.

Wij roepen U als volksvertegenwoordigers op er bij de Minister voor Vreemdelingenzaken en Integratie op aan te dringen dat zij zo spoedig mogelijk komt tot een moratorium wat betreft het stopzetten van voorzieningen en/of het uitzetten van gezinnen met kinderen. Dit in afwachting van een evaluatie van de Vreemdelingenwet 2000 in het licht van de verdragsverplichtingen die voortvloeien uit het Verdrag inzake de Rechten van het Kind.
